Report: Non-Family Molestation Victim Planning to Sue Josh Duggar
According to a report from InTouch, the tabloid that broke the Josh Duggar molestation scandal, one of Josh’s victims is planning to sue him in civil court. The report, which relies entirely on anonymous sources, claims that the suit will be filed by the one victim who is not in the Duggar family.
Based on the 2006 police report unearthed by InTouch in May, 19 Kids and Counting’s Josh Duggar molested five girls when he was a teenager, four of whom were his sisters. Two of his sisters, Jessa and Jill, came forward on Fox News last month to identify themselves as victims. The remaining three victims have so far remained silent.
According to InTouch, if the non-family victim does file suit, the Duggars will likely “have to answer every question as they will not be able to invoke their Fifth Amendment right against self-incrimination because the criminal statute of limitations has expired.” This means Josh’s parents Jim Bob and Michelle could have to reveal what they knew about Josh’s behavior and when, and what—if any—safeguards they put in place to keep him from offending.
Per InTouch, legal experts believe the non-family victim “still has the right to sue under Arkansas Code Annotated Section 16-56-130, which allows for a civil action when a sexual abuse victim start to experience the effects of the abuse years later.”
